Consumers` Protection

The legislation of the Republic of Moldova provides enhanced protection for consumers, as reflected in the modernized Civil Code (2019–2024), which contains regulations on abusive commercial practices, unfair terms in consumer contracts, as well as rules on product defects and the liability of professionals. These provisions complement the general legal framework established by Law No. 105/2003 on Consumer Protection, which largely transposes the relevant European Union directives.

The national legislation sets out the general requirements for consumer protection, including:

  • ensuring unrestricted access to safe products and services;
  • providing complete and accurate information regarding their essential characteristics;
  • safeguarding the rights and legitimate interests of consumers in cases of unfair or misleading commercial practices;
  • guaranteeing consumer participation in decision-making processes that concern them;
  • ensuring professional liability for non-compliant goods and access to consumer remedies (repair, replacement, price reduction, contract termination).

The competent authority in this field is the National Agency for Consumer Protection and Market Surveillance (ANPCSP), which has responsibilities in:

  • informing consumers about their rights and obligations;
  • monitoring compliance with consumer protection legislation;
  • identifying contraventions and applying sanctions in accordance with the Contravention Code;
  • overseeing product safety and supervising the market as a whole.
