{"id":1061,"date":"2021-04-04T23:47:39","date_gmt":"2021-04-04T23:47:39","guid":{"rendered":"https:\/\/balaban.md\/?p=1061"},"modified":"2021-04-08T11:05:44","modified_gmt":"2021-04-08T11:05:44","slug":"state-of-emergency-ii-in-the-republic-of-moldova","status":"publish","type":"post","link":"https:\/\/balaban.md\/ro\/state-of-emergency-ii-in-the-republic-of-moldova\/","title":{"rendered":"Starea de urgen\u021b\u0103 II Republica Moldova"},"content":{"rendered":"\n<p>Parlamentul revine la starea de urgen\u021b\u0103, pentru perioada 1 aprilie \u2013 30 mai 2021, prin Hot\u0103r\u00e2rea nr.49\/2021, copy paste de pe Hot\u0103r\u00e2rea nr.55\/2020. \u00cei succed\u0103 Comisia pentru Situa\u021bii Excep\u021bionale (\u201eCSE\u201d), care prin Dispozi\u021bia nr.1, \u00een vigoare din 1 aprilie 2021, continu\u0103 unele m\u0103suri impuse anterior de Comisia Na\u021bional\u0103 Extraordinar\u0103 de S\u0103n\u0103tate Public\u0103(\u201dCNSP\u201d), dar \u0219i impune m\u0103suri noi, precum urmeaz\u0103:<\/p>\n\n\n\n<p><strong>I.&nbsp;Regimul special de \u00eenv\u0103\u021b\u0103m\u00e2nt<\/strong><\/p>\n\n\n\n<p>(i) Procesul educa\u021bional&nbsp;se va desf\u0103\u0219ura la distan\u021b\u0103 \u00een localit\u0103\u021bile \u00een care se va atesta inciden\u021ba mai mare de 100 de cazuri COVID-19 la 100 mii popula\u021bie \u00een ultimele 14 zile, cu excep\u021bia institu\u021biilor de educa\u021bie timpurie.<\/p>\n\n\n\n<p>&nbsp;<strong>R\u0103m\u00e2n deschise&nbsp;(i)&nbsp;institu\u021biile antepre\u0219colare&nbsp;(0-2&nbsp;ani)&nbsp;\u0219i pre\u0219colare&nbsp;(2-6\/7 ani), dar \u0219i (ii)&nbsp;\u0219colile, gimnaziile, liceele \u0219i celelalte institu\u021bii de \u00eenv\u0103\u021b\u0103m\u00e2nt din localit\u0103\u021bile cu o rat\u0103 mai mic\u0103 de \u00eemboln\u0103vite.<\/strong><\/p>\n\n\n\n<p><strong>II. Regimul special de circula\u021bie al persoanelor<\/strong><\/p>\n\n\n\n<p>(i) &nbsp;Se interzice circula\u021bia&nbsp;\u0219i aflarea persoanelor \u00een spa\u021bii publice, aflate \u00een intravilanul localit\u0103\u021bilor: parcuri, p\u0103duri, terenuri de joac\u0103, terenuri sportive, zone de agrement.<br>R\u0103m\u00e2ne discutabil dac\u0103&nbsp;simpla traversare a&nbsp;parcului sau terenului este interzis\u0103, r\u0103spunsulva veni din&nbsp;practica judiciar\u0103 pe marginea contest\u0103rii ac\u021biunilor agen\u021bilor constatatori.<\/p>\n\n\n\n<p><strong>&nbsp;Circula\u021bia \u0219i aflarea \u00een p\u0103duri, parcuri sau zone de agrement din afara localit\u0103\u021bilor (extravilan)&nbsp;nu sunt interzise.<\/strong><\/p>\n\n\n\n<p>(ii) &nbsp;Se interzice, \u00eencep\u00e2nd cu&nbsp;<strong>3 aprilie&nbsp;<\/strong>2021,&nbsp;\u00een&nbsp;mun. Chi\u0219in\u0103u \u0219i&nbsp;B\u0103l\u021bi, circula\u021bia&nbsp;persoanelor \u00eenafara locuin\u021bei&nbsp;sau&nbsp;gospod\u0103riei \u00een intervalul orar&nbsp;<strong>23:00 \u2013 5:00<\/strong>, cu urm\u0103toarele excep\u021bii:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Deplasarea \u00een interes profesional, inclusiv&nbsp;spre din dinspre&nbsp;locuin\u021b\u0103\/gospod\u0103rie \u0219i locul de&nbsp;munc\u0103 sau desf\u0103\u0219urare a altei activit\u0103\u021bi (de \u00eentreprinz\u0103tor, independente, etc).<\/li><li>Deplasarea pentru asisten\u021b\u0103 medical\u0103 care nu poate fi am\u00e2nat\u0103 \u0219i nici realizat\u0103 de la distan\u021b\u0103, precum \u0219i pentru achizi\u021bia&nbsp;de medicamente.<\/li><li>Deplas\u0103ri \u00een afara localit\u0103\u021bilor ale persoanelor&nbsp;aflate \u00een tranzit sau&nbsp;care efectueaz\u0103 c\u0103l\u0103torii al c\u0103ror interval orar se suprapune cu perioada interdic\u021biei&nbsp;(cum ar fi cele efectuate cu avionul, trenul, autocare sau alte mijloace de transport de persoane), \u0219i care poate fi dovedit prin bilet sau orice alt\u0103 modalitate de achitare a c\u0103l\u0103toriei.<\/li><li>Deplasarea din motive justificate, precum \u00eengrijirea\/\u00eenso\u021birea copilului, asisten\u021ba persoanelor v\u00e2rstnice, bolnave sau cu dizabilit\u0103\u021bi ori decesul unui membru de&nbsp;familie.<\/li><\/ol>\n\n\n\n<p><strong>Concluzionind:<\/strong><\/p>\n\n\n\n<p>&#8211;<strong>interdic\u021biile nu se aplic\u0103 altor localit\u0103\u021bi&nbsp;(p\u00e2n\u0103 la alte decizii ale CSE), dar \u0219i<\/strong> <strong>deplas\u0103rii \u00een Chi\u0219in\u0103u \u0219i B\u0103l\u021bi&nbsp;\u2013&nbsp;\u00eentre orele 5:00&nbsp;\u0219i 23:00;<\/strong><\/p>\n\n\n\n<p>&#8211; &nbsp;<strong>la verificarea motivului deplas\u0103rii \u00een interes profesional, persoanele<\/strong> <strong>sunt obligate s\u0103 prezinte unul din urm\u0103toarele acte:&nbsp;legitima\u0163ia de serviciu, adeverin\u0163a eliberat\u0103 de angajator&nbsp;(pe suport h\u00e2rtie sau electronic), declara\u0163ia&nbsp;pe propria r\u0103spundere \u00een form\u0103 liber\u0103 (care s\u0103 con\u021bin\u0103 numele \u015fi prenumele, data na\u015fterii, adresa locului activit\u0103\u0163ii profesionale, durata deplas\u0103rii, data complet\u0103rii \u015fi semn\u0103tura);<\/strong><\/p>\n\n\n\n<p>&#8211; &nbsp;<strong>la verificarea motivului deplas\u0103rii \u00een interes personal persoanele sunt obligate s\u0103 prezinte declara\u0163ia&nbsp;pe propria r\u0103spundere \u00een form\u0103 liber\u0103&nbsp;(care s\u0103 con\u021bin\u0103 numele \u015fi prenumele, data na\u015fterii, adresa locuin\u0163ei\/gospod\u0103riei, motivul deplas\u0103rii, durata deplas\u0103rii, data \u015fi ora complet\u0103rii \u015fi semn\u0103tura).<\/strong><\/p>\n\n\n\n<p>(iii)&nbsp;Persoanele care se afl\u0103 \u00een afara domiciliului\/resedintei sau altui loc de trai, sunt obligate s\u0103 de\u0163in\u0103 asupra sa un act de identitate sau un alt \u00eenscris care confirm\u0103 identitatea persoanei(buletin de identitate, pa\u0219aport, permis de \u0219edere, etc.).&nbsp;<\/p>\n\n\n\n<p><strong>Concomitent,<\/strong><\/p>\n\n\n\n<p><strong>La 3&nbsp;aprilie 2021 autorot\u0103\u021bile&nbsp;municipale fiind \u00een dezacord cu decizia Comisiei pentru Situa\u021bii Excep\u021bionale (CSE) de a interzice aflarea \u00een parcuri \u0219i la terenuri de joac\u0103, au decis, printr-o decizie a Comisiei municipale de S\u0103n\u0103tate Public\u0103 admiterea afl\u0103rii cet\u0103\u021benilor \u00een spa\u021biile publice \u2013 parcuri sau terenuri de joac\u0103 \u00eentr-un grup de maxim trei persoane.<\/strong><\/p>\n\n\n\n<p><strong>! Cu toate aestea Dispozi\u021bia nr.1,&nbsp; din 1 aprilie 2021 este \u00een vigoare si vine in contradictie cu decizia Comisiei municipale de S\u0103n\u0103tate Public\u0103 in ce priveste admiterea afl\u0103rii cet\u0103\u021benilor \u00een spa\u021biile publice \u2013 parcuri sau terenuri de joac\u0103 \u00eentr-un grup de maxim trei persoane.<\/strong><\/p>\n\n\n\n<p><strong>III. Regimul special de munc\u0103<\/strong><\/p>\n\n\n\n<p>(i) &nbsp;Unit\u0103\u021bile (entit\u0103\u021bile)&nbsp;publice \u0219i private, cu excep\u021bia celor din domeniile de produc\u021bie \u0219i&nbsp;prestarea serviciilor, vor&nbsp;atrage&nbsp;la serviciu cu prezen\u021b\u0103 fizic\u0103, pentru activitate de birou, a unui num\u0103r de angaja\u021bi de p\u00e2n\u0103 la 30% din personal, iar pentru ceilal\u021bi angaja\u021bi se va dispune organizarea muncii la distan\u021b\u0103.<\/p>\n\n\n\n<p><strong>Unit\u0103\u021bile de produc\u021bie \u0219i de prestare a serviciilor sunt expres exceptate de la munca la distan\u021b\u0103.<\/strong><\/p>\n\n\n\n<p>(ii) &nbsp;\u00cen situa\u021bia \u00een care nu&nbsp;este posibil\u0103 activitatea&nbsp;\u00een regim la distan\u021b\u0103,&nbsp;programul&nbsp;de lucru&nbsp;va fi organizat pe grupe.<\/p>\n\n\n\n<p><strong>Conduc\u0103torii unit\u0103\u021bilor sunt liberi s\u0103 decid\u0103 m\u0103rimea grupelor, cu respectarea&nbsp;curespectarea m\u0103surilor obligatorii de prevenire a infec\u021biei COVID\u201319.<\/strong><\/p>\n\n\n\n<p>(iii) &nbsp;\u015eedin\u0163ele, \u00eentrunirile, reuniunile profesionale cu prezen\u0163a fizic\u0103 a&nbsp;persoanelor se vor organiza\u015fi desf\u0103\u015fura cu limitarea num\u0103rului de participan\u0163i reie\u015find din normativul&nbsp;4 m2 per&nbsp;persoan\u0103 din suprafa\u0163a util\u0103 a \u00eenc\u0103perii \u015fi vor dura&nbsp;nu mai mult de 60 min.<\/p>\n\n\n\n<p><strong>Limitele de mai sus nu se aplic\u0103 \u00eentrunirilor on-line, dar se aplic\u0103 celor \u00een form\u0103 hibrid\u0103\/mixt\u0103.<\/strong><\/p>\n\n\n\n<p>(iv) &nbsp;Agen\u021bia Servicii Publice&nbsp;va presta&nbsp;servicii \u00een baza program\u0103rii prealabile cu respectarea strict\u0103 a m\u0103surilor obligatorii de prevenire a infec\u021biei COVID\u201319.<\/p>\n\n\n\n<p><strong>Este recomandabil s\u0103 face\u021bi programarea prealabil\u0103 cu timp suficient \u00eenainte, or \u00een practic\u0103 sunt frecvente \u00eentreruperi planificate&nbsp;(datorit\u0103 lucr\u0103rilor de repara\u021bie&nbsp;etc) sau&nbsp;neplanificate&nbsp;(carantin\u0103)&nbsp;ale prest\u0103rii serviciilor publice.<\/strong><\/p>\n\n\n\n<p>(v) &nbsp;Serviciile OCT, care necesit\u0103 deplasare \u00een&nbsp;teren pentru efectuarea lucr\u0103rilor cadastrale, vor fiprestate&nbsp;\u021bin\u00e2nd&nbsp;cont de stricta necesitate.<\/p>\n\n\n\n<p><strong>Necesitatea va fi stabilit\u0103 discre\u021bionar de ofi\u021berii cadastrali, deci e recomandabil s\u0103 verifica\u021bi din timp disponibilitatea serviciului de \u00eenregistrare sau de alt gen.<\/strong><\/p>\n\n\n\n<p>(vi) &nbsp;Se sisteaz\u0103&nbsp;organizarea&nbsp;ceremoniilor de celebrare a \u00eenregistr\u0103rii&nbsp;nou-n\u0103scutului \u0219i c\u0103s\u0103toriilor jubiliare, inclusiv celebrarea c\u0103s\u0103toriei,&nbsp;iar&nbsp;\u00eencheierea c\u0103s\u0103toriei va avea loc exclusiv \u00een incinta serviciului stare civil\u0103\/centrului multifunc\u021bional \u0219i doar \u00een prezen\u021ba exclusiva a mirilor.<\/p>\n\n\n\n<p><strong>Respectiv, nu se admite \u0219i este sanc\u021bionabil\u0103 deplasarea \u00een afara OSC a ofi\u021berului st\u0103rii civile,&nbsp;dar \u0219i alaiurile care \u00eenso\u021besc ceremoniile&nbsp;de&nbsp;\u00eencheiere a c\u0103s\u0103torie.&nbsp;Nimic nu se opune \u00eens\u0103 celebr\u0103rii evenimentelor personale&nbsp;acas\u0103, cu respectarea \u00eens\u0103 a m\u0103surilor obligatorii de prevenire a infec\u021biei COVID\u201319.<\/strong><\/p>\n\n\n\n<p>(vii) &nbsp;Se interzice desf\u0103\u0219urarea&nbsp;adun\u0103rilor, \u00eentrunirilor, manifesta\u021biilor publice, mitingurilor \u0219i a altor ac\u021biuni de mas\u0103.<\/p>\n\n\n\n<p><strong>Cu scop&nbsp;chestionabil,&nbsp;CSE&nbsp;aparent \u00ee\u0219i dep\u0103\u0219e\u0219te atribu\u021biile legale atunci c\u00e2nd include, f\u0103r\u0103 temei legal, \u00eentrunirile \u00een aria actiunilor de mas\u0103.<\/strong><\/p>\n\n\n\n<p>(viii) &nbsp;Se interzice&nbsp;sistarea&nbsp;(prin deconectarea locurilor de consum) furniz\u0103rii serviciilor publice \u0219i\/sauaplicarea&nbsp;penalit\u0103\u021bilor pentru&nbsp;neachitarea de c\u0103tre consumatorii casnici a facturilor pentru energia electric\u0103, energia termic\u0103, gazele naturale, telefonie fix\u0103 sau apa potabil\u0103 consumat\u0103, cu excep\u021bia situa\u021biilor \u00een care deconectarea are drept scop evitarea punerii \u00een pericol a vie\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii oamenilor sau prejudicierea propriet\u0103\u021bii.<\/p>\n\n\n\n<p><strong>Interdic\u021bia nu se extinde asupra consumatorilor non-casnici, inclusiv produc\u0103torii \u0219i consumatorii angro.<\/strong><\/p>\n\n\n\n<p>(ix) &nbsp;Se instituie moratoriu, p\u00e2n\u0103 la data de&nbsp;<strong>30 mai 2021<\/strong>, asupra controalelor de stat planificate, efectuate la fa\u021ba locului, de c\u0103tre organele abilitate cu func\u021bii de control&nbsp;\u00een temeiul Legii nr.131\/2012, cu excep\u021bia controalelor efectuate de c\u0103tre Agen\u021bia Na\u021bional\u0103 pentru Siguran\u021baAlimentelor (ANSA), Agen\u021bia Na\u021bional\u0103 pentru S\u0103n\u0103tate Public\u0103&nbsp;(ANSP), Agen\u021bia Na\u021bional\u0103 pentru Reglementare \u00een Energetic\u0103&nbsp;(ANRE) &#8211;&nbsp;\u00een domeniul supravegherii energetice de stat \u0219 Inspectoratul pentru Protec\u021bia Mediului&nbsp;&#8211;&nbsp;\u00een privin\u021ba fondului forestier, spa\u021biilor verzi, ariilor naturale protejate de stat, fondului geologic \u0219i acvatic.<\/p>\n\n\n\n<p>&nbsp;<strong>Moratoriul nu se aplic\u0103 controalelor efectuate \u00een temeiul altor legi:<\/strong>&#8211;&nbsp;<strong>de c\u0103tre organele de urm\u0103rire penal\u0103<br><\/strong>&#8211;&nbsp;<strong>de c\u0103tre organele de control \u00een procesul auditului public<br><\/strong>&#8211;&nbsp;<strong>\u00een domeniul financiar (bancar \u015fi nebancar)<\/strong><\/p>\n\n\n\n<p>&#8211;<strong>\u00een procesul de trecere a frontierei de stat \u015fi \u00een domeniul vamal<br><\/strong>&#8211;&nbsp;<strong>de c\u0103tre Serviciul Fiscal de Stat, cu excep\u0163ia \u00eenregistr\u0103rii, supravegherii \u015fi<\/strong> <strong>raport\u0103rii controalelor \u00een Registrul de stat al controalelor<br><\/strong>&#8211;&nbsp;<strong>pentru identificarea cazurilor de desf\u0103\u015furare ilegal\u0103 a activit\u0103\u0163ii de<\/strong> <strong>\u00eentreprinz\u0103tor.<\/strong><\/p>\n\n\n\n<p><strong>IV. Alte m\u0103suri cu impact asupra activit\u0103\u021bii de afaceri<\/strong><\/p>\n\n\n\n<p>(i) &nbsp;Se sisteaz\u0103 desf\u0103\u0219ur\u0103rii adun\u0103rilor generale ale ac\u021bionarilor (anuale \u0219i extraordinare), \u021binute cu prezenta fizic\u0103 a ac\u021bionarilor sau \u00een form\u0103 mixt\u0103, \u00een cazurile \u00een care num\u0103rul de ac\u021bionari excede num\u0103rul de ac\u0163ionari excede num\u0103rul de persoane stabilit pentru \u00eentruniri de c\u0103tre CSE (a se vedea pct.III(iii) supra).<\/p>\n\n\n\n<p><strong>Restric\u021bia nu se aplic\u0103 deci adun\u0103rilor generale \u021binute prin coresponden\u021b\u0103 sau cu utilizarea mijloacelor de telecomunica\u021bii, potrivit prevederilor art.49 et seq. din Legea privind societ\u0103\u021bile per ac\u021biuni.<\/strong><\/p>\n\n\n\n<p><strong>Chiar dac\u0103 nu se men\u021bioneaz\u0103 expres, regulile de mai sus se aplic\u0103 prin analogie \u0219i adun\u0103rilor generale ale asocia\u021bilor \u00een SRL.<\/strong><\/p>\n\n\n\n<p>(ii) &nbsp;Se extind&nbsp;cu 60 de zile din data expir\u0103rii perioadei st\u0103rii de urgen\u021b\u0103&nbsp;(30 mai 2021) termenele de desf\u0103\u0219urare a adun\u0103rilor generale anuale a ac\u021bionarilor \u0219i de prezentare a d\u0103rilor de seam\u0103 anuale\/specializate ale participan\u021bilor profesioni\u0219ti la pia\u021ba de capital \u0219i ale emiten\u021bilor de valori mobiliare, precum \u0219i de efectuare a auditului situa\u021biilor financiare\/auditului tehnic al participan\u021bilor profesioni\u0219ti la pia\u021ba de capital.<\/p>\n\n\n\n<p>&nbsp;<strong>Potrivit legii,<\/strong><\/p>\n\n\n\n<p>&#8211; &nbsp;<strong>AGA anual\u0103 se \u021bine nu mai devreme de&nbsp;1&nbsp;lun\u0103 \u015fi nu mai t\u00e2rziu&nbsp;de 2&nbsp;luni de la<\/strong> <strong>data&nbsp;depunerii la organul de statistic\u0103 a situa\u021biilor financiare&nbsp;anuale.<\/strong><\/p>\n\n\n\n<p>&#8211;
