Competition Policy
Competition law and practice in Republic of Moldova are currently undergoing massive changes with the purpose of adopting EU provisions and adapting them to national law.
The Moldovan Republic competition law package includes rules on antitrust, merger control, state aid, public undertakings and services.
The competition legislation framework consists of Competition Law No. 183, as of July, 11, 2012 and the State Aid Law No. 139 as of June, 15, 2012. Both have the aim of harmonising national legislation on competition with EU Regulations.
Competition Law provides the legal framework for the protection of fair competition and it is aimed at preventing and combating anti-competitive practices. It covers conditions and control of mergers, abuse of dominant position, unfair competition.
The State Aid Law stipulates the mechanisms of authorizing, monitoring and reporting state aid grants to individuals and companies in all areas, except agriculture, for maintaining a normal competitive environment. All state aids must be approved by the Competition Council.
The Competition Council supervises compliance with competition and state-aid provisions. It can inquest breaches of competition legislation by its own motion or upon request of any individual or company affected by such infringement. According to the law, the Competition Council is entitled to request the termination of infringement, to apply fines, to prescribe behavioral or structural remedies.
